1. Your continued use of this web site constitutes your agreement to all such terms, conditions and notices, as they appear in this document. By accessing this website, you agree to be bound by the terms and conditions appearing in this document. If you are found in breech of the terms of this website or the Cyber Citizens community forums you will be subject to permanent removal from the game. 2. Cyber Citizens is a free online strategy game. By using this website you agree not to use rude, inappropriate, threatening, harassing, malicious, defamatory, or obscene comments, messages, citizen names, citizen bios, citizen avatars or any other such offensive content. If such content is used you will be subject to permanent removal from the game. Impersonating any of the Cyber Citizens staff may result in the players immediate ban. Moderator Harassment will not be tolerated on this game. 3. Keep in mind that while using this site there are many more players than moderators and you may run across content that you find objectionable. While reasonable efforts will be exerted to ensure the site remains free from offensive and illegal content, the site administrator(s) and/or moderator(s) cannot control what other people upload to our database in real time. You understand that in this case that Cyber Citizens is not responsible for content and information posted by its players. 4. By using this website you agree not to cheat in the form of abusing the fight system, trade system, or any other form of cheating with multiple accounts controlled by the same player. If you come across an exploit please report it to the appropriate administrator(s) and/or moderator(s). If you use the exploit you will be removed from this website. 5. If you are found in breech of the terms at any of the Cyber Citizens community portals (game, forums, etc...) your citizen will be subject to deletion without warning or notification. Citizen deletions can occur at any time by the Cyber Citizens administrator(s) and/or moderator(s) at their discretion. Cyber Citizens reserves the right to refuse or revoke membership to anyone at any time for any reason. If the game is ever shut down or reset no compensation of any kind will be provided. 6. All donations made to Cyber Citizens are non-refundable, no matter the reason. Once the transfer of ownership of the donation money has taken place, you are no longer entitled to the donated money. The donation bonus is final once it has been applied to your citizen. If the bonus is lost in the fight system, trades, other in-game activities, or unforeseen events donation bonuses will not be refunded or reapplied to your account. 7. When you submit information to Cyber Citizens, you grant the site and its administrator(s) a non-exclusive, royalty-free, worldwide, perpetual license to reproduce, distribute, transmit, and publicly display such content. You may not attempt to sell or profit from any such content or information via private exchanges without expressed administrative consent. 8. By using this service you agree not to access Cyber Citizens with any other programs than web browsers. Such other programs are in particular so called "Bots" as well as other tools that simulate, replace or supplement the web interface. The same applies to scripts and completely or partially automated programs that provide advantages towards other users and auto-refresh-functions and other browser integrated mechanisms. 9. Cyber Citizens is still in development and as a result game features and everything else may be subject to change at any time. We reserve the right to modify or withdraw, temporarily or permanently, this website (or any part of) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of Cyber Citizens. You will not be eligible for any compensation because you cannot use any part of this website or because of code issues, website failure, suspension or withdrawal of all or part of this website. 10. By using this service you agree not to attempt to access our servers, protected or coded data. You agree to do nothing that interferes with the ability of other Cyber Citizens members to enjoy playing the game in accordance with its rules, or that increases our expense or difficulty in maintaining the service. You agree not use this website for any illegal purposes, and you will use it in compliance with all applicable laws and regulations. You agree not to use this website in a way that may cause this website to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of this website is in any way impaired. 11. Cyber Citizens owns all intellectual property in the game. All rights and title in and to this website and the Service (including without limitation any user accounts, in-game purchases, computer code, themes, stories, dialogue, catch phrases, concepts, logos, methods of operation, moral rights, any related documentation, and user information) are owned by Cyber Citizens or its licensors. Donating towards the game does not create an ownership interest in the game or its contents. 12. If a player should voluntarily leave the game, if a player's account is deleted by the player him/her self or deleted/banned by administration for ANY REASON (cheating, violating the Cyber Citizens terms and conditions, violating official forum guidelines, reaching 100% warning level on the official forums, unstated reasons) or if the game is ever shut down or reset NO REFUNDS for previous donations and NO compensation will be provided to the player or to any re-created citizen. Charge-backs on donations are grounds for removal from the game. 13. Cyber Citizens has the right, but not the obligation, to monitor any activity and content associated with this website. We may investigate any reported violation of these conditions or complaints and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to your access and/or removing any materials from this website). 14. Cyber Citizens is not liable in any way for server breakdown, faulty programming etc. The occurrence of any disadvantages for a user resulting from server breakdowns, faulty programming etc. does not entitle the user to claim the recovery of his account's status before the occurrence or the recovery of any donation bonuses applied before the occurrence took place. 15. Cyber Citizens shall not be liable for any delay or failure to perform resulting from causes outside the reasonable control of Cyber Citizens including without limitation any failure to perform hereunder due to unforeseen circumstances or cause beyond our control such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor or materials. 16. You are responsible for maintaining a secure password to the site. You are responsible for the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to make efforts to use a complex password with unique characters and numbers and understand the importance of keeping your Cyber Citizens password different from all other websites that you visit. You agree to logout from your account at the end of each session using the logout link provided. You alone are fully liable for any loss or damage arising from your failure to comply with these security measures. 17. Such private exchanges that are forbidden include account selling, fight outsourcing, trades for real life money outside of the official Cyber Citizens donation system, and any other private exchange where individuals attempt to profit from the game. If you are found to be attempting to profit via private exchanges from Cyber Citizens you will be removed from this website. 18. By using this site you certify that you are at least thirteen years of age or have your legal guardian's permission to use this website and/or its forums. Where your country of access imposes laws regulating this web site, you agree to use your best efforts to comply with them. If you participate in Cyber Citizens it is up to you to check the laws applicable in your area. We are not liable for any damages caused by the use of Cyber Citizens. 19. The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association ("AAA") and, where appropriate, the AAA's Supplementary Procedures for Consumer Related Disputes ("AAA Consumer Rules"), both of which are available that the AAA website www.adr.org. 22.
